This Privacy Policy (“Privacy Policy”) along with the Terms of Use constitute a binding “Agreement” established by and between you and Zambezi.

This Privacy Policy does not apply to any products, goods, Websites, and/or content that are offered by third parties, which are governed by their respective privacy policies.

1. INFORMATION WE COLLECT

When you visit or use our Websites, we do not collect any information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“personal information”). You may, however, voluntarily provide your personal information in the course of interacting with our Websites, or otherwise using our Services. If you provide to us any personal information, we do not share it for cross-context behavioral advertising, or profiling. We do not knowingly collect, sell, or share personal information of users under thirteen (13) years of age; collect, sell, disclose or share sensitive personal information (as defined below). Cookies. We use cookies and similar technologies, such as pixels, to recognize you when you return to our Websites. We do that so we can deliver you personalized content and keep track of things you have already seen or interacted with. Our Websites may use HTTP cookies, HTML5 cookies, and other types of cookie technology to store information (such as type of device) in local storage.

Cookies are files with small amounts of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device's hard drive. Social Media. Our Websites include social media features which will redirect you to third-party social media companies. These third-party social media companies may collect your internet protocol (IP) address, which page you were visiting on the Websites, and the social media platform may set a cookie to recognize you and enable the feature to function properly. Social media features and widgets are either hosted by the third-party social media companies or hosted directly on the Websites. Your interactions with these features are governed by the privacy practices of the third-party social media companies that provide them. This Privacy Policy applies solely to information under our control. Zambezi is not responsible for the privacy practices of the social media platforms you use in connection with our Services. Zambezi is not responsible for the privacy practices of social media platforms. We recommend that you review their privacy policies and practices.

Do not Track Signals (“DNT”). Some web browsers have a setting which requests that a web application disable its tracking of an individual user. When you choose to turn on the DNT setting in your browser, your browser sends a special signal to websites, analytics companies, ad networks, plug in providers, and other web services you encounter while browsing to stop tracking your activity. Various third parties are developing or have developed signals or other mechanisms for the expression of consumer choice regarding the collection of information about an individual consumer’s online activities over time and across third-party websites or online services (e.g., browser do not track signals), but there is no universally-agreed upon standard for what a company should do when it detects a DNT signal. Currently, we do not monitor or take any action with respect to these signals or other mechanisms.

2. USE OF PERSONAL INFORMATION

  • To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to ask a question about our Services, we will use that personal information to respond to your inquiry.

In the preceding twelve (12) months, we have shared personal information with the following categories of service providers:

Third-Party Service Providers: We share information, including certain personal information, with our third-party service providers that we use to: who perform services on our behalf, including without limitation marketing, market research, customer support, data storage and data analytics, analysis and processing, and legal services, to manage our relationships, correspondence and record-keeping in respect of clients and prospective clients.process authentication and log-in information; provide hosting for and maintenance of our Services, e-mail marketing, scheduling meetings, backup, storage, payment processing, analytics and other services for us. These third-party service providers may have access to or process your personal information for the purpose of providing these services for us.

Analytics: We may collect, and we may engage third-party analytics providers to collect, metrics and information regarding your use of the Services, including evaluating how visitors use our Services to develop new features, improve existing features or inform sales and marketing strategies. Legal or Regulatory Purposes: We share information with governmental and regulatory entities as necessary to fulfill our legal obligations, comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

We may aggregate, de-identify, and/or anonymize any information collected. We may use and share this aggregated and anonymized information (non-personal information) for any purpose, including without limitation, for research and marketing purposes, and may share such data with our Affiliates and third parties.

4. MANAGING COMMUNICATION PREFERENCES

Some of our Websites offer an option to subscribe for updates and other content related to BITES and Social Scoop. If you provide your email to us to effectuate your subscription we will use your email to send you updates regarding our Services and other content related to BITES and Social Scoop. You can always unsubscribe from any email communications from us by following the “unsubscribe” link provided in our email communications.

5. RETENTION OF PERSONAL INFORMATION

We will retain your personal information for as long as needed to respond to your request or fulfill the other purpose for which you have provided your personal information and as necessary to comply with our legal obligations, resolve disputes and/or enforce our agreements.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

When you delete data, we follow a deletion policy to make sure that your data is safely and completely removed from our servers or retained only in anonymized form. However, please note even after you have closed your account or have stopped using our Website, we may continue to store your personal data if doing so is necessary for us to fulfil our legal obligations. 6. CHILDREN’S PRIVACY

Our Websites are not intended to be used by children. We do not request, or knowingly collect, any personal information from children. If you are the parent or guardian of a child who you believe has provided their information to us, please contact us at privacy@zmbz.com to request the deletion of that information. If we learn that we have collected personal information from a child thirteen (13) years of age or younger, we delete such information immediately.

7. YOUR RIGHTS AND CHOICES

Some states have enacted privacy laws that provide consumers with specific rights regarding their personal information. The scope of your rights may vary depending in which state you reside. This section generally describes your rights and explains how to exercise those rights.

  • Right To Know And The Right To Data Portability – You may request that we disclose to you the categories of personal information we collect about you, the categories of sources from which we collected that personal information, the categories of personal information we sold or disclosed, our business or commercial purposes for collecting and selling such personal information, the categories of third parties with whom we shared such personal information, and the specific pieces of personal information we collected about you, but only over the past 12 months.

  • Right To Request Deletion of Your Information – You may request we delete some or all of the personal information we maintain about you, subject to certain exceptions. If we cannot delete all of your personal information, we will give you a reason why we cannot do so. For security reasons, you or your authorized agent may be asked to verify your/their identity. Note that some personal data may be retained as permitted by law (e.g. to comply with legal obligations, to prevent fraud, etc.).

  • Opt-out of “Sale”/ “Sharing” of Your Personal Information ––We do not currently consider the ways we shared personal information in the past 12 months to comprise the “sale” of personal information.

  • Right to Correct Inaccurate Personal Information. Taking into account the nature of the personal information and the purposes of the processing, this right provides an individual with the ability to seek to correct or update personal data that individual considers that we hold about that individual.

  • Right to Limit Use of Sensitive Information. This right is limited to sensitive personal information used for the purpose of inferring characteristics about an individual. We do not collect sensitive personal information nor do we use sensitive personal information for the purpose of inferring characteristics about an individual, therefore we do not offer a path to exercise this right.

  • Right of Non-Discrimination and Non Retaliation. This right prohibits (a) denying an individual access to or use of goods and services, (b) charging different prices or rates for those goods and services, and/or (c) providing a different level or quality of those goods or services, as a result of the individual exercising any right(s) under any data protection and/or privacy laws and/or regulations. We will not discriminate against you because you made any of these requests. We will not: (i) deny you goods or services; (ii) charge you different prices or rates for those goods or services, including through granting discounts or other benefits, or imposing penalties; (iii) provide you with a different level or quality of our goods or services, or (iv) suggest that you may receive a different price or rate for our goods or services or a different level or quality of our goods or services. However, we may offer you certain financial incentives that can result in different prices, rates, or quality levels. Any permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

  • Right to opt out of the processing of your personal data for the purposes of targeted advertising and for profiling in furtherance of decisions, including, solely automated decisions that produce legal or similarly significant effects.

  • Right to appeal any decision or indecision related to the exercise of any right the consumer is granted under the applicable state law.

We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, to process transactions and facilitate customer requests, and/or to protect against fraud and other misuse of our Websites. We will take reasonable steps to verify your identity prior to responding to certain of your requests. The verification steps will vary depending on the sensitivity of the personal information. In some locations, you may designate an authorized agent to make a request on your behalf. When submitting such a request, please ensure you have adequately identified and authorized anyone acting on your behalf.

9. RESPONSE TIMING AND FORMAT

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at privacy@zmbz.com.

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

10. CHANGES TO OUR PRIVACY POLICY

We reserve the right to amend this Privacy Policy at our discretion and at any time. When we make changes to this Privacy Policy, we will post the updated notice about the Websites and update the notice's effective date. Your continued use of our Websites following the posting of changes constitutes your acceptance of such changes.
